URGENT NOTICE: Possible Breach of Therapeutic Goods Advertising Code – Catalyst Program scheduled for 8th August 2013 on Fluoridation

GENRE:  Email notice

TITLE:  URGENT NOTICE: Possible Breach of Therapeutic Goods Advertising Code –

Catalyst Program scheduled for 8th August 2013 on Fluoridation

TO:  ABC Secretariat, Board Executive Officer

AUTHOR:  Monica M, Qld, Australia,

STATUS;  No response required

DATE WRITTEN:  4th August, 2013

The ABC website advises that the ABC Board is responsible for ensuring that the gathering and presentation of news and information is accurate and impartial, according to recognised standards of journalism, and that the ABC complies with legislative and legal requirements.

I write this pursuant to Part II Section 45 Innocent Intentions of the Criminal Code Act 1899.

Further to my email to the ABC Catalyst Content Manager on 2/8/13, it has come to my attention that the broadcasting of the program relating to fluoridation and how it protects your teeth, may include content which may be in breach of the Therapeutic Goods Advertising Code.

The Therapeutic Goods Administration (TGA) have advised myself and others that fluorides used in the fluoridation of drinking water supplies are included in Section 5 Item 10 of the current Excluded Goods Order, ie.

Substances for use in the purification or treatment of drinking water …

If no claims are made for therapeutic use

Please refer to the legislative instrument for the full text:

Therapeutic Goods Act 1989 Therapeutic Goods (Excluded Goods) Order No. 1 of 2011

In the case of fluorides used in the fluoridation of drinking water supplies, a therapeutic claim is being made ie for the prevention of tooth decay (or varying words to that effect) and as such may not comply with sections of the Therapeutic Goods Advertising Code.  I would therefore respectfully request that you ensure that the program complies with the current legislation as noted above.

If the information I have received regarding the content of this ABC Catalyst program is incorrect, and that it does not intend to make any therapeutic claims for fluorides used in the fluoridation of drinking water, then please disregard this notice.

Disclaimer:  Before relying on the information contained in this email in any important matter, you should carefully evaluate its accuracy, currency, completeness and relevance for your purposes, and should obtain any appropriate professional advice relevant to your particular circumstances.  The author prohibits the dissemination of the contents of this email and any distribution or copying must show it in its entirety, including this disclaimer.

  1. Unfortunately it is a long time since the ABC’s reporting has been “accurate and impartial, according to recognized standards of journalism.” In fact, it is a long time since ANY of the mainstream media have met these standards.
